HOLIDAY INN ON KING PRIVACY POLICY

At the Holiday Inn On King (“Hotel”,“we”,“our ”or “ us ”), we are committed to protecting the privacy and the confidentiality of personal information that is shared with us by those who stay with us (“Guests”, “you”, or “your”). In order to comply with applicable privacy legislation and to instill confidence in our Guests that the personal information they entrust to us is safe, we have developed this Hotel Privacy Policy. We want our Guests to know why we ask for their personal information, how we use it, what safeguards we employ, and how to contact us with privacy-related questions.

PERSONAL INFORMATION AND WHY IT IS COLLECTED:

In this Privacy Policy, “Personal Information” means information that specifically identifies a Guest as an individual and is provided to or collected by the Hotel. The type of Personal Information the Hotel collects, uses and discloses may include without limitation, an individual’s name, age, residential mailing address, residential phone numbers or email addresses, personal financial and credit information, citizenship, and place of employment, and personal preferences.

The Hotel collects and uses Personal Information for the following purposes:

• Maintaining a record of our Guests’ stay with us for customer service and to better facilitate our Guests’ next check-in;
• Meeting our Guests’ personal preferences and needs during their stay at the Hotel;
• Advising our Guests of goods and services offered by, or by arrangement with the Hotel;
• Improving the goods and services we offer to Guests in the future;
• Compliance with all municipal, provincial, federal and other applicable laws regarding your stay at the Hotel;
• Advising Guests of present and future marketing campaigns via newsletters and promotional materials;
• Confirming information necessary for credit transactions with our Guests; and
• Such other specific purposes which are communicated to the Guest by the Hotel and its staff before collection.

When Personal Information is to be used for a purpose not previously identified, the new purpose will be identified prior to use.

PERSONAL INFORMATION AND CONSENT:

The Hotel does not collect, use or disclose a Guest’s Personal Information without their knowledge and consent, except in certain extraordinary circumstances. Such extraordinary circumstances include without limitation, when legal, medical or security reasons make it impossible or impractical to obtain consent. The most common methods we use to obtain consent to collect and use Guest Personal Information are by Guests submitting completed registration cards, providing Personal Information to Hotel staff members over the phone, and by making an reservation through the Holiday Inn On-line Reservations system.

We may use, share among us and disclose a Guest’s Personal Information to our subsidiaries, affiliates, associates, agents, suppliers, and such other third parties as the Hotel, acting reasonably, may deem necessary for the fulfillment of the purposes noted above or where otherwise permitted or required by law. In the unlikely event that the Hotel or substantially all of its assets are acquired by a third party, your Personal Information may be one of the transferred assets.

Our Guests may withdraw their consent at any time, subject to any legal or contractual restrictions and reasonable notice. A Guest’s refusal to provide, or withdrawal of, his/her consent may affect the Hotel’s ability to provide you with its services. The Hotel will inform the Guest of the implications of such withdrawal. To withdraw consent, a Guest should contact the Chief Privacy Officer (see below) at 370 King Street West, Toronto, Ontario, M5V 1J9 or at privacyofficer@hiok.com.

LIMITING COLLECTION AND RETENTION OF PERSONAL INFORMATION:

The Hotel limits the collection of a Guest’s Personal Information to that which is necessary for the purposes identified above in this Privacy Policy, or for any additional purpose identified to the Guest before collection of the Personal Information. As well, Personal Information is not used or disclosed for purposes other than those for which it was originally collected, except with the consent of the Guest or as required by law. Personal information is only retained as long as necessary for the fulfillment of these purposes, after which it is destroyed, erased, or rendered anonymous.

ACCURACY:

The Hotel strives to ensure that Guests’ Personal Information is as accurate, complete, and up-to-date as is necessary for the purposes for which it is used.

SAFEGUARDS:

The Hotel has security safeguards in place designed to protect against loss, theft, unauthorized access, disclosure, copying, use or modification of Guests’ Personal Information in the care of the Hotel. The nature of the safeguards will depend on the sensitivity, format, location and storage of the Personal Information. Such measures include locked cabinets, computer passwords, and encryption software.

ACCOUNTABILITY, OPENNESS AND GUEST ACCESS:

The Hotel is responsible for the Personal Information under its control and has appointed a Chief Privacy Officer to ensure that we comply with all applicable privacy legislation and the terms of this Privacy Policy. The Chief Privacy Officer and those designated by the Chief Privacy Officer (the “Privacy Team”) address and investigate questions or concerns regarding a Guest’s Personal Information. The Hotel will provide a Guest access to their Personal Information. The Hotel will correct or amend any inaccuracies in the Guest’s Personal Information. The Hotel has the right to refuse a Guest’s request for access to personal information if:

• The information is protected by legal privilege;
• Granting access would reveal confidential commercial information;
• Doing so would reasonably be expected to threaten the life of security of another individual;
• The information was collected for purposes related to the detection and prevention of fraud;
• The information was generated in the course of a formal dispute resolution process; or
• The information would likely reveal personal information about another individual.

CHALLENGING COMPLIANCE:

Guests are encouraged to discuss any privacy issues with the Chief Privacy Officer or a member of the Privacy Team. Upon request, the Hotel will inform a Guest on the procedures in place to receive and respond to complaints or inquiries about the Hotel’s policies and practices relating to the handling of Personal Information.
